Preamble

The Other Store is a company that develops, implements and runs the operations of commercial websites, including sales and back office functions, in its own name on behalf of its clients, along with other associated activities, such as marketing these websites and promoting the products for sale.


The Other Store was thus enlisted with the development and management of the https://www.laurenvidal.com/en_fr/ website (hereafter "the Website") under their own name but on behalf of LAUREN VIDAL, a French SAS (simplified joint stock company - société par actions simplifiée) with share capital of 1 000 000€, with headquarters at 22 rue Delizy 93500 PANTIN, France, registered in the Bobigny trade and companies register under no. B 389 107 558.

These General Terms and Conditions of Sale were drawn up for the purpose of setting forth the rules applicable to the sale of products carrying the Lauren Vidal brand (hereafter “the Product(s)”) on the Website,

Any non-trading natural person of legal age, with the legal capacity to enter into contracts, purchasing a Product on the Website (hereafter “the Client”), exclusively residing in the United Kingdom.

For the purposes herein, it is agreed that the Client and The Other Store shall collectively be referred to as the “Parties” and individually as the “Party”.

These general terms and conditions (hereafter "Terms and Conditions”) govern, without limitation, the Product sales conducted by The Other Store on behalf of Lauren Vidal on the website.

The Other Store reserves the right to modify these Terms and Conditions at any time via publication of a new version on the Website. The Terms and Conditions in force on the Website on the day an order is placed by the Client are those to be applied; with the understanding that all orders for a Product offered on the Website imply the Client’s full and comprehensive adherence to the Terms and Conditions in force at the time of placing the order..

Article 1 • Purpose

These General Terms and Conditions for Sales are intended to define the conditions under which the Products are marketed by The Other Store on behalf of Lauren Vidal to the customer. They deal with the different steps in the sales progress from the moment the Customer places his order.

Article 2 • Products

Products offerend for sale by The Other Store on behalf of Lauren Vidal are those listed on the Website the day of their consultation by the Customer; it being understood that the photographs illustrating the products are not contractual. Each product will be a description, which, in addition to photography, includes: price, photography, availability of sizes and colors, compositions and special features. Small differences may exist between the product and its photography, depending on the screen resolution and the definition of colors of the screen of the computer of the user.

The Other Store is committed to delivering products that meet the applicable regulations relating to safety and health in accordance to the European clauses, and in particular the legislation on chemical regulations.

Article 3 • Prices

The prices are indicated in euros, tax included, and delivery costs excluded; understanding that the value added tax is that which is in force on the French metropolitan territory on the day that the order is validated.

The prices applied are those given on the Site and confirmed when the Customer confirms his order.

The delivery costs are shown on the order summary before the Customer confirms the latter and includes all taxes. These costs are at the expense of the Customer and are invoiced in addition to the sale price of the Products.

The transfer of risk for loss and damage to the Products will be made after delivery and receipt of the Products by the Customer.

We reserve the right to modify our prices at any moment but will apply the current rates as indicated to you on the site at the time the order was placed.

We would like to inform you that if an obviously incorrect price appears on our website (a price that is clearly too low, for example), and for whatever reason (IT bug, human error, technical error etc.), your order will be cancelled, even if it has been initially validated.

Article 4 • Order and Payment of the Products

• 4.1 Placing an order

The Customer completes his order by filling in the following 5 steps:

Step 1: The Customer selects the chosen Products and adds them to the shopping basket after having selected the desired size and colour.

The basket at the top and to the right of the screen shows the Customer that it has taken into account his selection by indicating the number of Products it contains.

Step 2: The Customer may check the contents of his basket by clicking on “order” to have access to the summary of his order. The Customer may change his order (Product, size, quantity).

The total amount of the order, taxes included, are shown in the summary and are distinguished by the price of the Products and the delivery costs.

Step 3: Once the order has been checked and, if necessary, changed, the Customer validates his basket in order to finalise his order by re-clicking on “order”.

If the Customer has a promotion code, reserved for best Customers, he must enter it in the space provided, in order to take advantage of this promotion.

Step 4: Input by the Customer for delivery and billing details.

Apart from the date of birth, address and delivery information, it is necessary that all the fields are filled in for the finalisation of the order; understanding that unless the Customer gives different instructions, the billing address will automatically be the same address for the delivery.

If the Customer has previously ordered on the Site, then he has a Customer account. If this is the case, he may identify himself using only his email address and password.

The Customer then checks all the information and clicks on “validate” for the follow up of his order.

Step 5: Input of banking details.

The Customer then accesses the screen for secure payment with the partner of The Other Store as specified in article 4.3 below.

Payment carried out online is uniquely paid by credit card.

The Customer must enter his credit card number, the validity date, as well as the 3 visual cryptogram numbers found on the reverse side of the card, understanding that in the case of payment with an American Express card, the Customer must enter 4 numbers.

If the payment is accepted, the Customer will be redirected to the screen where the order is confirmed on the Site.

In the case where the payment fails, the Customer will have up to 3 attempts to re-enter his banking details. After the 3rd attempt, the Customer will be redirected to a screen on the Site that shows the refusal for payment. The Customer will be invited to contact Lauren Vidal Customer service to find out the reason for the non payment, and to find a solution to finalise the order.

• 4.2 Confirmation of the order

As soon as the payment is accepted, the Customer will receive an email confirming his order, summarising the articles ordered, the billing and delivery address as well as the delivery date.

The validation of the order by the Customer and the confirmation of the order is sent to the Customer by email by The Other Store on behalf of Lauren Vidal, following the payment being accepted and concludes a sales contract between the Parties and acceptance of the General Terms and Conditions for Sales.

The Customer having placed an order has the possibility to print his invoice by connecting to the follow-up of orders space provided for on the Site.

The Other Store reserves the right to not validate an order in the case of:

  • - abnormal or abusive claims,
  • - abnormal orders with regards to the quantities ordered,
  • - abnormal or abusive exchanges or returns,
  • - existing litigation with the Customer.

The Lauren Vidal Customer service is available for all questions relating to the Customers order. The Customer service is available by email : eshop.laurenvidal@serviceclient.the-oz.com, or over the phone 09 74 76 50 84, Monday to Friday, from 10:00 to 18:00.

• 4.3 Payment

The price of the Products purchased are payable in cash, in full on the day that the Customer places the order. The payment is carried out online with a bank card (Carte Bleue, Visa, Eurocard/Mastercard/ American Express/ Bancontact) at the time when the order is confirmed by the Customer.

The request for a direct debit on the card is carried out at the moment the order is validated on the site, except if the servers are unavailable. The Other Store reserves the right to carry out a new request for a direct debit in the case where the first request was not successful due to the unavailability of the servers.

In the case of non-payment, an incorrect address or any other problem with the Customers account, The Other Store reserves the right to block the Customers order until the problem is resolved.

In the case of fraudulent use of his credit card on the Site, the Customer is invited to contact Lauren Vidal at the following number: 09 74 76 50 84 Monday to Friday from 10:00 to 18:00 or by email at the following address: eshop.laurenvidal@serviceclient.the-oz.com.

All transactions made on the website are secured by the payment system put in place by The Other Store’s partner, Adyen, a French simplified joint stock company (SAS - société par actions simplifiée) with share capital of 40,000 euros, with headquarters based at 5 rue de Rochechouart, 75009 Paris, France, registered in the Paris trade and companies register under no. 435 236 898.

All information exchanged for payment processing is encrypted by SSL (Secure Socket Layer) technology. This data can be neither picked up, nor intercepted, nor used by a third party. At no point does the financial data of a Client go through The Other Store’s IT system. Adyen checks that the connection with the Client’s browser is secure before sending the payment form to the bank charged with making the financial transaction

Ayden is a technical services provider, and thus has no involvement in disputes over orders. These are dealt with directly by The Other Store as detailed above, or (where applicable) by the Client’s bank.

• 4.4 Archiving orders

Order confirmations are saved in The Other Store’s records, which are themselves stored on a reliable and sustainable platform. The Client accepts that confirmation of an order be deemed proof of a contractual agreement between the Parties.

Article 5 • Delivery

Lauren Vidal shall deliver the order shipments along with a proof of delivery note within maximum ten (10) working days for a delivery to France mainland, maximum twenty (20) working days for a delivery to all, from the day following the payment for the order.

All orders registered on the Site, Monday to Friday before 14:00 will be processed the same day; after 14:00, they will be processed the next day. All orders placed on Friday after 14:00, on Saturday and Sunday will be processed the following Monday; understanding that orders placed on bank holidays will be processed the next working day.

In the case where the delivery delay is exceeded, and not justified by a force majeure, the Customer may request a cancellation of the sale and obtain a refund within a maximum delay of thirty (30) days.

For orders outside of France, when the exported package reaches its destination, the recipient must pay the taxes or customs duty that apply to the country of destination. Local authorities can provide this information.

Article 6 •Taking delivery of an Order – Complaints – Returns

The Client is responsible for checking the Products received further to their order when taking delivery of the shipment. Any irregularity with respect to the shipment, such as:

  • - Damaged packaging,
  • - Missing products,
  • - Damaged products,
  • - Products not matching the order,

must be notified within the statutory timeframe following receipt thereof.

Such notification shall be sent to Lauren Vidal website Customer Service:

Once this timeframe has elapsed, unless there is a hidden defect, The Other Store shall entertain no complaints and the Products shall thus be deemed acceptable.

For any return of a non-compliant Product, the Client must follow the following procedure:

  • - The Client must include in their return package the completed returns slip printed off from the returns slip help section of their customer account under “My Orders”. No returns will be accepted without this duly completed slip.
  • - The Products must be returned either in their original packaging or in alternative packaging that adequately protects the Product from any damage, along with all labels and any other additional elements enabling them to be resold, to the following address:

  • - No return or exchange in physical shops will be accepted.
  • - All risks and returns delivery costs are exclusively borne by the Client.

In the event that the Product is deemed non-compliant, The Other Store will offer the Client a refund of the total cost of the order (cost of the Products and delivery charges), as well as the return delivery costs for the non-compliant Product within a maximum of thirty (30) days from the day The Other Store customer service sent notification that the Product was confirmed as non-compliant.
In the case of a refund, Lauren Vidal assures to refund in full the products returned conform, as well as the shipping expenses, with the exception of the taxes and custom duty paid by the Customer for the delivery. Returns via cash on delivery will not be accepted. Upon receipt of a non-compliant item, Lauren Vidal is responsible for refunding the return delivery costs as per current rates. The Client must send proof of the return delivery costs paid to Customer Service by email or post. In the case of abnormal or abusive claims, Lauren Vidal may refuse to accept future orders.

Article 7 • Right of withdrawal

The Client is granted a period of thirty (30) days as from receipt of the shipment to return it.

For all returns, the following procedure must be adhered to in its entirety:

  • - The Client must include in their return package the completed returns slip printed off from the returns slip help section of their customer account under “My Orders”. No returns will be accepted without this duly completed slip.
  • - The Products must be returned either in their original packaging or in alternative packaging that adequately protects the Product from any damage, along with all labels and any other additional elements enabling them to be resold, to the following address:

  • - Return delivery costs are borne by the Client, while shipping fees are refunded by The Other Store on confirmation that the order is returned intact. All refunds are applied to the same bank card used to make the purchase within 30 days of returning the package.

Article 8 • Personal Data

The Other Store collects information needed for order processing.

This information is not only needed for THE OTHER STORE to process a Client’s order, but also to give the Client information on the Lauren Vidal brand, the Website, or to extend Lauren Vidal offers to them; if the Client accepts same by validating their order.

This information is strictly confidential, marked by an asterisk (*) when necessary for The Other Store and/or their subcontractors as part of management of the Client’s order.

Following any request from the authorities or in order to defend its rights or those of its employees, clients, or other person, The Other Store may pass on this data to legally empowered organisations or authorities.

The Other Store commits to taking all appropriate precautions to ensure that its data and computing system are secure and protected, in particular to preventing any of the Client’s personal data from being tampered with, damaged or accessed by any unauthorised third party.

The personal information of the Client is sent to and stored by the web hosting company, located in France, whose contact details are displayed on the Website under “Legal Notices”.

The Client has the right to object to, access, rectify, and delete any of their personal data in accordance with the provisions of EU Directive 2016/679 of the European Parliament and Council of April 27, 2016, of the national legislations of European Union member states, and of the French Data Protection Act (loi Informatique et Libertés) no. 78-17 of January 6, 1978 and no. 2004-801 of August 6, 2004. The Client may also alter their personal contact details via their customer account by logging in with their email and password.

Article 9 • Cookies

In order to process the Client’s order, and with the aim of understanding customer needs and personalising the services provided on the Website, The Other Store uses cookies. A cookie is a digital file stored on the hard drive of the Client’s computer designed to indicate when they visit the Website.

Cookies log the duration of a Client’s visit to the Website, their identity (based on their email address and password), and the contents of their basket. Once a Client logs off the Website, this data is stored for thirty (30) days before being permanently deleted.

The Client may object to cookies being logged via their Internet server settings. In doing so, they lose all personalisation of the services offered on the Website.

Article 10 • Limitation of Liability

Placing an order on the Website entails understanding and acceptance of the procedures currently in force on the Internet network, in particular regarding technical efficiency, response and connection times, information requests or transfers, risk of breakdown, risk of catching a virus circulating on the network, and generally all risks relating to the use of an Internet network.

The Other Store may therefore not be held in any way responsible for direct or indirect harm resulting from incorrect use, for any incident linked to the use of a computer, for Internet access, for server maintenance, for server or telephone line or other technical connection failure. Connecting to the Website is entirely the Client’s own responsibility.

Article 11 • Force Majeure

The Other Store shall not be liable for any total or partial failure to fulfil its obligations in respect of an order placed by the Client, if this failure is caused by circumstances constituting a force majeure event, as defined by substantive law.

In such cases, the Customer Service will notify the Client by email that such an event has occurred within three (3) clear days following the occurrence of said event.

Once a timeframe of one (1) month has elapsed, should the event meeting the criteria of force majeure still be ongoing, the order will be cancelled and, where applicable, a refund will be applied by THE OTHER STORE to the same card used to place the order, within a maximum timeframe of thirty (30) days.

Article 12 • Applicable Law

Should any one of the terms in these Terms and Conditions be deemed null and void, illegal, or unenforceable by a court ruling, the other terms of these Terms and Conditions will still be applicable.

These Terms and Conditions will be executed and interpreted in accordance with French law.

In the event of a dispute, the Client shall first contact The Other Store for amicable resolution. Should no agreement be reached, the Client may then refer the matter to the competent common law courts, or apply for mediation with a view to reaching an amicable settlement.
